CareWhile's California Privacy Notice

1. PURPOSE

CareWhile Homecare, LLC (“CareWhile”, “we”, “us” or “our”) takes the protection of your data seriously and is committed to respecting your online privacy.

 

The California Consumer Privacy Act of 2018 (“CCPA”) provides California residents (consumers) with specific rights with respect to their personal information. This policy describes the specific rights of such individuals and explains how those rights may be exercised. The Company reserves the right to change this Policy from time to time to align with any regulatory, legal, case law or internal development that may arise.

2. DEFINITIONS

The following constitute examples of types of CCPA personal data that we may collect and process:

  • Identification: Name, physical address, phone number, email, account details, payment information, signature, social security number, driver’s license or state ID number, which may be used to identify a consumer or household as defined in California Civil Code1798.80(e)

  • Employment: Title, current/former employer, compensation, benefits, performance, employment details

  • Device & Geolocation: Based on devices that you use to connect with our services (includes mobile devices, connected devices, wired and wireless sensors which have geolocation features, or by deduction from the information that we collect – e.g. IP address may be region specific to which we can associate with a zip code)

  • Cyber: Browsing history, search history, device and browser information, including data about your interactions with and use of our services and social media

  • Demographic: Includes sex, gender, age, disability, marital status, veteran status, ethnicity, race, religious beliefs, sexual orientation, citizenship/immigration status

  • Education: Includes data on your educational background that might not be accessible to the public as defined in the Family Educational Rights and Privacy Act.

  • Sensory: Referring to Visual, Audio, Electronic or similar information as could be obtained from cameras or microphones (e.g. during video conferencing or over the phone).

 

Health and Medical information are covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA)

 

Other personal information is covered by certain sector specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Data from the fields of CCPA personal information above may be provided to our service providers to the extent needed for them to fulfill our business requirements.

3. RIGHTS AND CHOICES

This section describes your rights as consumers (California residents) and explains how to exercise those rights:

 

Right to Know: This refers to your right to be notified of the groups of CCPA personal data that will be collected either before or at the point of collection and to be made aware of the purposes for which the data will be used and shared.

Right to Access: This refers to your right to request the groups of CCPA personal data that were collected over the last 12 months, information on the sources from which the data was obtained, details on the specific CCPA personal data that was collected on you, and the business purpose for which the data was collected and shared. You may also have the right to request your CCPA personal information that was disclosed for business purposes and the types of third parties in the 12 months preceding your request for your CCPA data. In situations where this data was delivered electronically, the data shall be portable and to the extent technically feasible, be in a readily useable format.

 

Right to Delete: This refers to your right to have your CCPA personal data deleted. Note however, that we may not be able to fulfill your deletion request if we or our service providers are required to retain this data for one or more of the following reasons:

  • To close out a transaction for which the CCPA data was collected e.g. provision of a service that you requested or completion of a contract between you and CareWhile

  • To maintain website functionality, integrity and security

  • To ensure compliance with a legal obligation or exercise rights under the law

  • To use your CCPA personal data internally in a lawful manner that is compatible with the context to which you had provided it

 

Right to Opt-Out: This refers to your right to out-out of the sale of your CCAP personal data. We have no reason to believe that we have sold CCPA personal information since the Company was launched.

 

Right to Non-Discrimination: This refers to your right not to receive discriminatory treatment by any business when you exercise your California privacy rights and you will not be discriminated against in any way by virtue of you exercising these rights. This implies that we will not deny services to you, provide different prices or rates for services to you or provide a different level or quality of service to you as a result of you exercising your California Privacy Rights.

Prior to fulfilling your request, we may need to verify your identity. Additional information may be requested if we are not able to initially verify your identity. Personal information that you disclose to us as part of the verification process will only be used for the purpose of verification.

Some requests may be denied or fulfilled only in part, as permitted by law (e.g. requirements for record retention stipulated by the California Department of Social Services). The CCPA allots California consumers with the right to file a complaint with the California Attorney General’s office. The Attorney General’s office may be contacted at https://oag.ca.gov/contact/consumer-complaint-against-business-or-company.
