CareWhile's Privacy Policy Statement

CareWhile Homecare, LLC (“CareWhile”, “we”, “us” or “our”) takes the protection of your data seriously and is committed to respecting your online privacy.

 

This Privacy Policy (“Policy”) applies to information collected by CareWhile through use of the CareWhile website at www.carewhile.com, and governs the data collection and its usage. This Policy has been developed to inform you of the conditions under which we collect, process, use and protect your personal data. Please take a moment to familiarize yourself with the types of personal data that are subject to aggregation, processing, our usage of this data and who we are likely to share it with. Details on how you may contact us are also included in this policy. By using or accessing the site, you consent to the data practices described in this statement.

2. COLLECTION OF YOUR PERSONAL INFORMATION

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain services. These may include:

  • Sending us an email or alternative message

  • Signing up for a promotion

  • Submitting your credit card or other payment information when booking services

To which, we will use your information for, but not limited to communicating with you in relation to services that you have requested from us. We may also gather personal or non-personal information in the future.

3. REFERENCES TO OTHER SITES

There are instances where we provide links to other sites to provide additional insight or for convenience. Some of these websites are operated independently of CareWhile and are not under our control. These websites are owned and run by third parties that have their own respective confidentiality recommendations or terms of use. We do not accept liability with regard to the content of these sites, for the products and services that may be offered there or for any other use thereof.

4. PERSONAL DATA COLLECTED AND USED BY US

The following constitute examples of types of personal data that we may collect and process:

Employment: Title, current/former employer, compensation, benefits, performance, employment details

Device & Geolocation: Based on devices that you use to connect with our services (includes mobile devices, connected devices, wired and wireless sensors which have geolocation features, or by deduction from the information that we collect – e.g. IP address may be region specific to which we can associate with a zip code)

Cyber:  Browsing history, search history, device and browser information, including data about your interactions with and use of our services and social media

Demographic: Includes sex, gender, age, disability, marital status, veteran status, ethnicity, race, religious beliefs, sexual orientation, citizenship/immigration status

5. AUTOMATICALLY COLLECTED PERSONAL DATA

The Company may automatically collect information about your computer hardware and software. This information can include your IP address, cookies, browser type, domain names, access times, statistics and referring website addresses. This information is used for the operation of the service, to maintain quality of the service and to provide general statistics regarding the use of the Company’s website.

6. PURPOSES FOR WHICH WE USE PERSONAL DATA

The Company collects and uses your personal information in the following ways:

  • To operate and deliver the services you have requested

  • To provide you with information or services that you request from us

  • To provide you with notices about services received

The Company may also use your personally identifiable information to inform you of other services available from the Company.

7. DISCLOSURE OF PERSONAL DATA

Your personal data may be disclosed under the following circumstances:

Legal or Safety: In cases where we believe in good faith that the use, preservation or disclosure of personal information is necessary within reason to:

  • Detect, prevent or respond to fraud or other security/technical concerns

  • Investigate or enforce any potential violation of the Terms of Use

  • Comply with/ satisfy legal requirements, regulations, state or other governmental requests

  • Facilitate audits and other compliance departments

  • Protect the safety, property and rights of CarewWhile, its clients or the public from harm

Merger or Sale: In the event that we are involved in an acquisition, merger, sale, or transfer of some or all of our business, whether it be as part of bankruptcy, liquidation, ongoing concern or similar proceeding. One’s personal information may be transferred with the business. In cases where we are legally required, we will provide prior notice and information on whether you have the legal right to object to the transfer.

Service Provider: There may be some instances where we hire a service provider to operate a subset of our business and as such, we may provide them with access to personal information as necessary to perform these services. Such providers may be involved in site operations, general communications and public interactions.

8. STORAGE PERIOD OF YOUR PERSONAL DATA

Personal information will be retained for as long as necessary to satisfy the purpose for which it was collected and processed as stated in this Privacy Policy, or in alignment with any longer retention period required by law. This period may be extended if applicable, for any amount of time prescribed by any legal or regulatory body’s provisions that may apply.

9. CHILDREN'S POLICY

The Company does not knowingly collect personally identifiable information from children under the age of 13. If we become aware that we have unknowingly collected the Personal Information from a child under 13 years of age, we will make commercially reasonable efforts to delete this information from our database.

10. SHARING INFORMATION WITH THIRD PARTIES

The company does not sell, rent or lease its customer lists to third parties.

 

The Company may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, phone number) is transferred to the third party. The Company may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for other services. All such third parties are prohibited from using your personal information except to provide these services to the Company, and they are required to maintain the confidentiality of your information.

11. OPT-OUT OF DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

In connection with any personal information we may disclose to a third party for a business purpose, you have the right to know the categories of personal information thaw we disclosed about you for a business purpose.

You the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to opt out of the disclosure of your personal information. If you exercise your right to opt out of the disclosure of your personal information, we will refrain from disclosing your personal information, unless you subsequently provide express authorization for the disclosure of your personal information. 12. TRACKING USER BEHAVIOR

The Company may keep track of the websites and pages our users visit within the Company, in order to determine what Company services are the most popular. This data is used to deliver customized content and advertising within the Company to customers whose behavior indicates that they are interested in a particular subject area.

13. RIGHT TO DELETION

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records

  • Direct any service providers to delete your personal information from their records

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us

  • Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity; or prosecute those responsible for that activity

  • Debug to identify and repair errors that impair existing intended functionality

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law

  • Comply with the California Electronic Communications Privacy Act

  • Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us

  • Comply with an existing legal obligation or

  • Otherwise use your personal information internally, in a lawful manner that is compatible with the context in which you provided the information.

14. SECURITY

We are committed to ensuring that your Personal Information remains secure. To prevent unauthorized access or disclosure, we have implemented suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. Our hardware, software, and security infrastructure as well as our internal standards for this Site meet current industry standards and technology. We also request that our third-party service providers use commercially reasonable security measures to protect your information from unauthorized access. However, due to the open communication nature of the Internet, we cannot guarantee that communications between us will be free from unauthorized access by third parties in a manner that is inconsistent with this Privacy Policy.

15. SMS TERMS AND CONDITIONS

By accessing or using our services, including receiving and responding to SMS communications via the phone number you provided, you agree to comply with and be bound by these terms and conditions. Please do not engage with our services if you do not agree with these terms.

Clients or visitors who have consented to receive text messages may receive SMS communications related to their booked services or other relevant information. Applicants for job postings who have consented to receive text messages may receive updates on their application status, onboarding details or other employment related information.

Message frequency may vary in alignment with the level of interaction that you have with us. You may opt-out of receiving SMS messages at any time by texting “STOP” to the number from which you received the message.

 

CareWhile will only respond back to potential/existing clients, employees or visitors who ask to be contacted on our website or other verifiable means. CareWhile does not charge any feeds for inquires or text messages on our website from potential clients, employees or other site visitors. However, you may be charged by your own cell provider for texting CareWhile.

16. CHANGES TO THIS STATEMENT

The Company reserves the right to change this Policy from time to time. For example, when there are changes in our services, changes in our data protection practices or changes in the law. When changes to this Policy are significant, we will inform you. You may receive a notice via an email to the primary email address specified in your account with us, by placing a prominent notice at CareWhile Homecare, LLC, and/or by updating any privacy information. Your continued use of the website and/or services available after such modifications will constitute your acknowledgement of the modified Policy and agreement to abide and be bound by that Policy.
